7th Sky Software (“Company,” “we,” “our,” or “us”) provides WordPress plugins and extensions (“Software”). By using our Software, you (“Licensee”) agree to these Terms of Service.
1. License Summary
- Core plugins are released under the GPL (General Public License) and are free to download, use and modify.
- Premium extensions and plugins are provided under a commercial license, allowing modification but prohibiting distribution of derivative works.
- Support is provided according to the terms below.
2. License Grant
For premium extensions and plugins, we grant Licensee a:
- Non-exclusive, non-transferable, perpetual, commercial, royalty-free license
- License to modify the source code but not to distribute modifications
- License for personal or business use without sublicensing or reselling
This license allows Licensee to:
- Install and use the Software on their website(s) and server(s)
- Permit third parties to interact with the Software via Licensee’s website(s)
- Modify the Software for personal use but not distribute modified versions
This license remains valid unless terminated by breach of the terms.
3. Restrictions
Licensee may not:
- Redistribute, resell, sublicense, or transfer the Software
- Distribute modified versions or derivative works of premium plugins
- Claim ownership or authorship of the Software
4. Support & Maintenance
We provide limited support for premium plugins and extensions, including:
- Assistance with installation and basic troubleshooting
- Updates, security patches, and bug fixes
- Priority support based on the selected support plan
Support does not cover:
- Conflicts caused by third-party themes or plugins
- Custom development or modifications
5. Termination
We may terminate this license if Licensee:
- Breaches any terms of this agreement
- Uses the Software for illegal or unauthorized purposes
- Attempts to sublicense, resell, or distribute premium extensions
6. Payments & Refunds
Payments:
- Premium extensions require a one-time or subscription-based payment
- Payments are processed securely via third-party providers
Refunds:
- Refunds are available within 15 days of purchase if the Software fails to perform its core functions
- Licensee must first contact support and allow us to resolve the issue
- Refunds are not granted due to compatibility issues with third-party software, personal preference, or failure to read product descriptions
7. Updates & Fixes
We may provide updates, upgrades, and fixes, including:
- Upgrades: Major feature improvements and performance enhancements
- Updates: Minor improvements and additional features
- Fixes: Bug resolutions for smoother operation
Licensee agrees to keep the Software updated.
8. Liability & Warranty
- The Software is provided as-is without warranties of any kind.
- We are not responsible for any damages, losses, or conflicts arising from its use.
- Licensee assumes all risks associated with installing and using the Software.
9. Intellectual Property
- 7th Sky Software retains ownership of all premium plugins and extensions.
- Licensee may modify but not distribute derivative works.
- Licensee agrees not to claim authorship or trademark any part of the Software.
10. Indemnification
Licensee agrees to indemnify and hold harmless 7th Sky Software from any claims, liabilities, or legal disputes arising from misuse of the Software.
11. Governing Law & Disputes
- These terms are governed by USA laws.
- Any legal disputes shall be resolved in USA.
- Licensee waives the right to participate in class-action lawsuits against 7th Sky Software.
